Important reminder to all faculty members from the Data Privacy Office

Please be reminded that the grade(s) of each Student in a class is (are) considered private information. Therefore, the Teacher/Faculty giving the class SHOULD NOT assign to a student (whether or not s/he is a student in the Class) the task of recording, compiling, processing in any manner the grades of the other students. Otherwise, assigning a student to record the grades of his/her classmates can be a very serious violation of the Data Privacy Act of 2012 and the University's Privacy Policy.

However, should there be a compelling reason for a student (whether or not in the same Class) to be assigned any or all of these tasks, the concerned Faculty and the whole Class should conform to the provisions of the Data Privacy Act of 2012 and the University's Privacy Policy by doing the following:

  • FIRST, the whole class should unanimously agree that there is a compelling reason for this assignment to be given to a student.
  • SECOND, the whole class should agree that any justification would be based on the Data Privacy principles of transparency, legitimate purpose, proportionality, and data quality.
    - Check out Republic Act 10173 and its Implementing Rules and Regulations to know more about these principles. Here, Google is your friend.
The whole class should provide their consent to the Faculty member either in writing or via a permanent recording (Video with Audio and a Time Stamp) and submit the evidence to the University's Data Privacy Office ([email protected]) before the assignment is carried out by the student.
    - The Consent should include (a) ALL the students in the class, (b) a detailed listing of the assigned task(s), and (c) the valid period for their consent (e.g., only for a quiz, or until the end of the current semester, etc.).
    - The Faculty member should use his/her email to submit the written or recorded consent.
  • Once the University's Data Privacy Office gives its approval through the requesting Faculty member, the student can start carrying out the assigned tasks, and only during the time period indicated by the consent agreement of the whole class.

Thank you for your compliance.
